These Terms of Service ("Terms") govern your access to and use of Depify's API monitoring platform, website, and related services (collectively, the "Service") operated by Depify ("we," "our," or "us") from Bangalore, India. Please read these Terms carefully before using the Service.
By creating an account or using the Service, you agree to be bound by these Terms, our Privacy Policy, and any additional terms applicable to specific features. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. If you do not agree to these Terms, do not use the Service.
To use the Service, you must create an account. You agree to:
Each account is associated with one workspace. You may invite team members to collaborate within your workspace based on your plan limits. You must be at least 18 years of age to create an account.

We continuously improve the Service and may add, modify, or discontinue features with reasonable notice.
You agree to use the Service responsibly and in compliance with all applicable laws. You must not:
Each plan includes specific usage limits. Current limits include but are not limited to:
If you exceed your plan limits, we will notify you and may temporarily restrict excess usage until you upgrade or reduce usage. We will not delete your data due to limit overages without prior notice.
Your data belongs to you. You retain all ownership rights to your data, including API monitoring configurations, collected response data, feature flag rules, and webhook payloads.
By using the Service, you grant us a limited license to process, store, and display your data solely for the purpose of providing and improving the Service. We will not access your data for any other purpose without your consent, except as required by law.
You can export your data at any time in standard formats (JSON, CSV) from your dashboard. Upon account deletion, all your data will be permanently removed within 30 days.

Service Credits: If we fail to meet the SLA in a given month, Pro and Enterprise customers are eligible for service credits:
Scheduled maintenance windows (announced at least 48 hours in advance) are excluded from SLA calculations. To claim credits, contact us within 30 days of the incident.

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of laws principles. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Bangalore, Karnataka, India.

Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction to prevent irreparable harm.
